Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and the developer of Your Daily Deviled Egg (“Oeufware,” “we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and the rules of the app store you downloaded it from. You may not copy, modify, reverse-engineer, resell, or redistribute the App or its content except as allowed by law.

2. Recipes are for general information — food safety & allergies

The recipes, tips, and nutritional or serving suggestions in the App are provided for general informational and entertainment purposes only.

Food safety: Eggs and other perishable ingredients can carry a risk of foodborne illness if undercooked, mishandled, or stored improperly. You are responsible for following safe food-handling and cooking practices, including proper cooking temperatures and refrigeration.

Allergies & dietary needs: Recipes may contain or reference common allergens (such as eggs, dairy, mustard, nuts, soy, or fish). Always check ingredients and prepared foods for allergens and consult a qualified professional about your dietary or medical needs.

We make no warranty that any recipe is safe, accurate, complete, or suitable for your circumstances, and we are not responsible for how you prepare or consume food.

3. Subscriptions (Plus and Pro)

The App offers optional auto-renewing subscriptions that unlock additional features and content (“Plus” and “Pro”). Purchases are processed by the Apple App Store or Google Play, not by us.

Billing & renewal: Subscriptions renew automatically for the same period and price unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

Managing & canceling: Manage or cancel your subscription in your Apple or Google account settings after purchase. Uninstalling the App does not cancel a subscription.

Refunds: Payments are handled by the app stores and are subject to their refund policies. Except where required by law, subscription fees are non-refundable.

Price changes: We may change subscription pricing or features; changes apply to future billing periods and, where required, only after notice and/or your consent.

4. Community contributions

The App lets you contribute ratings and share recipes, which feed community statistics (Top Rated, Most Shared, Most Visited). You agree to use these features honestly and not to manipulate, spam, or abuse them. By contributing, you grant us a worldwide, royalty-free license to use the aggregated, anonymous contribution to operate and improve the App.

5. Acceptable use

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to disrupt, overload, or gain unauthorized access to our systems or service providers; (c) interfere with other users’ use of the App; or (d) circumvent security, rate limits, or subscription gating.

6. Intellectual property

The App, including its text, recipes, images, design, and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited license in Section 1, no rights are granted to you.

7. Third-party services

The App relies on third-party services, including Google Firebase, RevenueCat, and the Apple and Google app stores. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECIPE OR INFORMATION IS ACCURATE OR RELIABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY ILLNESS, INJURY, OR LOSS RELATED TO PREPARING OR CONSUMING FOOD. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $10.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or if we discontinue the App. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 2, 6, 8, 9, and 10) will survive.

12. Governing law

These Terms are governed by the laws of Wyoming, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there, except where prohibited by law.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after changes take effect means you accept the updated Terms.

Apple is not a party to these Terms and is not responsible for the App or its content. These Terms are between you and the developer. If you downloaded the App from the Apple App Store, the “Licensed Application End User License Agreement” (Apple standard EULA) also applies, and Apple and its subsidiaries are third-party beneficiaries with the right to enforce these Terms against you.
